Terms of Service for Gut Score

Please read these Terms of Service ("Terms") carefully before using the Gut Score mobile application ("App", "Service", "we", "us", or "our").

1. Acceptance of Terms

By downloading, installing, or using Gut Score, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of Service

Gut Score is a mobile application that:

• Analyzes photos of meals using artificial intelligence
• Calculates a gut health score based on detected food items
• Tracks meal history and provides health insights
• Offers optional premium features including cross-device synchronization

3. Eligibility

• You must be at least 13 years old to use this App
• If you are under 18, you must have permission from a parent or guardian
• You must provide accurate information when creating an account

4. User Account

4.1 Account Creation

• You may use the App with or without creating an account
• Account creation requires authentication through Google Sign-In
• You are responsible for maintaining the confidentiality of your account

4.2 Account Termination

• To delete your account, please contact support@sdmai.org
• We reserve the right to suspend or terminate accounts that violate these Terms
• Upon termination, your data will be deleted within 30 days

5. User Content

5.1 Meal Photos

• You retain ownership of photos you upload
• By uploading photos, you grant us a license to process and analyze them for providing our Service
• Do not upload photos containing offensive, illegal, or harmful content
• Do not upload photos of other people without their consent

5.2 Data Accuracy

• AI-based food detection may not be 100% accurate
• You are responsible for verifying and editing detected food items
• Scores are estimates and should not replace professional medical advice

6. Premium Features

6.1 Purchases

• Premium features are available through one-time purchases via Stripe
• All purchases are final and non-refundable except as required by law
• Premium features include cross-device synchronization and cloud backup

6.2 Pricing

• Prices are displayed in your local currency
• We reserve the right to change pricing with reasonable notice
• Price changes do not affect existing premium users

7. Prohibited Conduct

You agree NOT to:

• Use the App for any illegal purpose
• Attempt to reverse engineer, decompile, or hack the App
• Circumvent any security features or usage limits
• Use automated tools to access the App (bots, scrapers)
• Upload malicious content or viruses
• Impersonate others or create fake accounts
• Abuse or overload our servers

8. Intellectual Property

• The App, including its design, code, and algorithms, is our intellectual property
• Our trademarks, logos, and branding may not be used without permission
• You may not copy, modify, or distribute the App

9. Disclaimers and Limitations of Liability

9.1 Service "As Is"

• The App is provided "as is" without warranties of any kind
• We do not guarantee uninterrupted, error-free, or secure operation
• AI analysis may contain inaccuracies or errors

9.2 Health Disclaimer

• Gut Score does not provide medical advice, diagnosis, or treatment
• Do not rely solely on the App for health decisions
• Consult healthcare professionals for medical concerns
• The App is not a substitute for professional medical advice

9.3 Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for premium features (if any)
• We are not responsible for data loss, health outcomes, or decisions made based on the App

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Content you upload to the App

11. Third-Party Services

The App uses third-party services including:

• Google Sign-In: Governed by Google's Terms of Service
• Stripe: Payment processing governed by Stripe's Terms
• Supabase: Database services governed by Supabase's Terms

We are not responsible for third-party services or their terms.

12. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

13. Changes to Terms

• We may update these Terms at any time
• Material changes will be notified through the App or via email
• Continued use after changes constitutes acceptance
• If you disagree with changes, you must stop using the App

14. Termination

We reserve the right to:

• Suspend or terminate the Service at any time
• Terminate your access for violations of these Terms
• Discontinue features or the entire App with reasonable notice

15. Governing Law and Disputes

15.1 Governing Law

These Terms are governed by the laws of India. Any disputes arising out of these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.

15.2 Dispute Resolution

• Most disputes can be resolved by contacting us directly
• If informal resolution fails, disputes will be resolved through binding arbitration
• You waive the right to participate in class action lawsuits

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gut Score regarding use of the App.

By using Gut Score, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
